I see, that makes sense. Thanks.

It does make a difference that more of US law is statute-based. An awful lot of English law is common law, based on precedent rather than legislation. I gather that the entire 'duty of care' concept springs from a case involving food-poisoning from ginger beer! (Donoghue vs Stevenson 1932)
